5. RIM's silly semantics








Research In Motion (RIMM) reported its fiscal first-quarter results late last week, beating analysts' earnings estimates by 1 cent while missing sales estimates by an ugly $200 million. Research In Motion also significantly lowered its outlook for the full year. The lowered guidance had traders unloading RIM's stock -- it's down nearly 20% since last Friday and sitting near multiyear lows -- almost as quickly as customers are abandoning its gadgets in favor of Apple's (AAPL) iPhone and devices powered by Google's (GOOG) Android operating system.







Jim Balsillie and Mike Lazaridis, the company's co-CEOs, didn't help things when they engaged in a semantics debate on a call with analysts. After announcing a wide-reaching plan to overhaul its organization through new product launches, cutbacks and layoffs, Balsillie challenged an analyst for referring to his reforms as a "restructuring." 4. Netflix flux







Is it just us or has there been way too much nonsense at Netflix (NFLX) lately? The DVD rental and film-streaming company has performed far from flawlessly over the past week. Not only did the company's Web site go down on Sunday, but last Friday the company clashed with both Sony (SNE) and a group representing users with hearing difficulties, leading us to ask if its highflying stock may soon be grounded.







As for its weekend service woes, Netflix took its time but eventually restored operations, finally allowing its irate customers to stop airing their discontent on Twitter. Despite its recovery, however, the company made subscribers madder still by not offering a reason for the interruption. In an e-mail to Bloomberg, Netflix said that the outage was not caused by a hack attack, yet offered no other information. Read more







3. End of the CenturyLink?







Here's a new reason to consider shorting CenturyLink (CTL): The company put its name on a stadium.







On Thursday, Qwest Field, home to the NFL's Seattle Seahawks, was officially renamed CenturyLink Field. It was originally called Seahawks Stadium but was renamed in June 2004 when Qwest acquired naming rights. CenturyLink purchased Qwest last year in a $10.6 billion stock deal that included the assumption of nearly $12 billion in debt. Shares of the company are down more than 13% year to date. Carson Block, the controversial short-seller who has written reports critical of Chinese companies through his firm Muddy Waters Research, was the victim of a prank on Tuesday when a false press release posted on Briefingwire.com said the Securities and Exchange Commission had charged him with stock manipulation.

The return of Eddie Lampert, chairman of Sears Holdings (SHLD), to the real estate business is striking fear in 6,000 of the retailer's employees and the state of Illinois.

Sears is considering moving its corporate headquarters away from its Hoffman Estates campus outside Chicago. Sears, which opened its first store in Chicago in 1887, was originally lured to its current 2.4 million square feet site in 1989 as a result of a sweet tax deal from the state reportedly worth $240 million. That deal expires next year which is why the retailer is testing the waters for cheaper and smaller digs outside Illinois.

Judge Gregory H. Lewis of the Orange County Superior Court appointed Jameson after rejecting a competing request by Shah and OCPIN to force IHHI's management to call a special shareholders' meeting. Shah and OCPIN wanted the special shareholders' meeting to elect their own director. Shah and OCPIN opposed Judge Lewis' appointment of a provisional director.Integrated Healthcare Holdings, Inc. (IHHI) is a physician-owned company that operates four hospital facilities in Orange County, California (referred to as the Hospitals). In denying Shah and OCPIN's request, and in appointing Judge Jameson to serve as a "verifiably independent" provisional director, Judge Lewis explained he was acting as "the conscience of the community" to ensure continued operation of four Orange County hospitals owned and operated by IHHI. "Judge Lewis acted courageously," remarked IHHI attorney David A. Robinson of the Irvine-based Enterprise Counsel Group. "Although acknowledging the law normally would entitle Shah and OCPIN to hold a meeting to elect their own director, Judge Lewis recognized the conflicting financial interests at work and acted to prevent a potential public healthcare disaster. He agreed with IHHI's management that IHHI's Board should be controlled by individuals with only the interests of four hospitals and the public they serve in mind."



"This is precisely the result we were looking for when we filed the lawsuit against Shah and OCPIN," said IHHI's President Larry Anderson. "Shah's self-serving tactics have put four hospitals at risk. They have caused IHHI to default on its existing loan obligations. We look to Judge Jameson to work with IHHI's other independent Board members to implement steps necessary to ensure IHHI's future stability and success". Per IHHI CEO, Bruce Mogel: "We praise the judge's courage in standing up for healthcare in Orange County. This decision will provide much needed stability benefiting the healthcare delivery system in Orange County and surrounding areas."

Discover Financial Services (DFS, news) delighted Wall Street on June 23 with a fiscal second-quarter profit that tripled from a year earlier as credit-card delinquency rates fell to a 25-year low, allowing the company to set aside less money to cover losses.




There was positive revenue growth, too; a 5% increase in total loans painted a rosier portrait of its consumers than analysts had expected. The increase bodes well for Discover's efforts to generate more revenue based on new business and less on avoiding bad loans.



Discover, based in the Chicago suburb of Riverwoods, Ill., recently executed a series of deals designed to attract new customers with products other than credit cards. What's ahead for the stock market


Two big inflation reports and earnings from Best Buy, Kroger, Pier 1 Imports and Research In Motion will help decide if the market can stabilize after the past week's drubbing. But the market now faces some strong head winds.



21You recommend this43%You don't recommend this57%Shared 45 timesFirst the good news. The stock market isn't falling apart. It's not 2008. Not even close. The Dow Jones industrials ($INDU) are still up 3.2% for the year. By this time in 2008, the blue chips were down 8.9%.



It's not 2010 either. By June 11, 2010, the Dow and the Standard & Poor's 500 Index ($INX) were down 2.1% for the year. Admittedly, the Nasdaq Composite Index ($COMPX) was up 1.1% at the time. It's now in the red for 2011.



But the market is in a pullback. Maybe one can call it a correction. In time, the market will regain its momentum. But probably not in the coming week. The economic reports aren't likely to bring much cheer, and some of the earnings reports due next week, particularly Research In Motion (RIMM), may generate some heartache.



The market may continue to move lower, but the conditions for a rebound are forming. Consumers are going to have a bit more cash in their pockets. Here's why.

Oil prices are not headed higher. A schism is developing within the Organization of Petroleum Exporting Countries, and there may be more oil coming on to the global market than expected.




Gasoline prices are off more than 6.5% since peaking in early May. Oil and gasoline prices tend to peak in June and July and sink slowly into about January.



Many commodity prices are lower, particularly copper and cotton. Wheat prices are down 8.8% since peaking in March because of better-looking crops, particularly in Russia. Corn, used to feed livestock, is a different matter because of heavy flooding in the Midwest.



Interest rates aren't going wildly higher any time soon. The Federal Reserve doesn't want to be the cause for the next recession.



And the odds are the Japanese economy will be looking stronger late this summer. Economists and pundits alike have gotten two things wrong this year: the impact of higher fuel prices on the economy and the startlingly broad impact of the Japanese earthquake on the global economy.



The global economy needs two things, apparently, to function perfectly: a happy U.S. consumer and humming factories in Japan to spit out cars, auto and motor vehicle parts and all sorts of electronics that are used in factories around the world, including the United States.



Parts of Japan are recovering fairly quickly. Toyota expects its Japanese production to be back to normal by August.



That said, the market does face some big issues going forward. Here are five:



The market needs to locate its support. That's a level that sets off a new round of buying. The S&P 500 closed at 1,270 on Friday, down 1.4%, and broke below a very important support level. That was 1,275, the low the index reached during the Egyptian revolution in January. The next big support level is about 1,260, which the index held at the end of December.



The transports are negative. The Dow Jones Transportation Average ($DJT) went negative for the year on Wednesday and ended Friday off 0.9% for 2011. Many traders watch the index carefully because it tends to be a leading indicator. The average is being hurt most by its airline components, including JetBlue (JBLU), Delta Air Lines (DAL), American Airlines parent AMR (AMR) and Southwest Airlines (LUV). These are most vulnerable to rising fuel costs and consumers worried about jobs. If oil prices continue to move lower and consumer confidence rises, the airline stocks will move higher again.



The banks need to show some strength. That means they feel more comfortable about lending to consumers and businesses alike. The issue appears to be their horror of additional regulation. The counterargument is that regulation was significantly weakened in the first decade of the century, and the industry went crazy lending on real estate. And no one wants to go through that horror again. Only two of the 24 stocks in the Philadelphia KBW Banking Index are higher for the year: Capital One (COF) and Commerce Bankshares CBSH). Goldman Sachs (GS), Bank of America (BAC) and Citigroup (C) are each down 19% or more on the year.



You don't know how the budget battle will break. State and local governments are cutting staff swiftly; government employment is, in fact, falling while private-sector employment is still growing. What's not clear is how and if a deal will be made to raise the U.S. debt ceiling. If the government is forced to shut down, consumer spending will drop, and the economy will shrink. If government spending is cut too fast, you get the same result.



The Europeans have to find a solution to Greece. This is not an academic argument. Many of the largest banks in Europe have money tied up in Greece, and a bad solution could destabilize them. That would have global implications. Think what happened when Lehman Bros. failed in the fall of 2008.



That said, here's what the market faces in the week ahead.

Earnings: Best Buy, Kroger and Research In Motion

This is the back end of the second-quarter earnings season. But the week ahead has some reports that can move markets.



Best Buy, fiscal-first-quarter results, due Tuesday before the open. Best Buy (BBY) shares fell 7.2% in the past week and are off 10.5% so far this month. There's a big crowd of short-sellers trying to drive the shares lower. Watch for the company's commentary on consumer willingness to buy appliances and other big electronics. The Street expects 33 cents a share in earnings, down from 36 cents a year ago. Revenue is estimated at $10.71 billion, down from $10.79 billion a year ago.



Sino-Forest, first-quarter results, due Tuesday before the open. To say Sino-Forest (SNOFF) is a controversial stock is an understatement. The operator of tree plantations in China has lost 82% of its value since the end of March. Most of that loss has occurred in the past week after a short-seller charged that the entire company has grossly inflated its assets. The company is disputing the charges.



Kroger, first-quarter results, due Tuesday before the open. Kroger (KR), one of the largest supermarket chains, is expected to report 64 cents a share in earnings, up from 58 cents a year ago, with revenue of 26.5 billion, up 6.8% from a year ago. Two big questions: How well is it competing against Wal-Mart Stores (WMT) and how is it coping with inflation pressures?



Research In Motion, fiscal-first-quarter earnings, due after Thursday's close. Research In Motion's lot is to have created the smartphone and then lose all the glory to Apple's (AAPL) iPhone. The shares are down 37% this year -- 14.5% in June alone. The Street sees sales rising 22% to $5.16 billion but earnings falling to $1.33 a share from $1.38 a year ago. The problem: It's having to sacrifice profit margin to get the business.



The economy: CPI, PPI, retail sales, housing starts and manufacturing

The week will tell us a lot about the economy. Here's a quick rundown.



Retail sales for May, due Tuesday from the Commerce Department. The consensus estimate is for a 0.5% decline, the first since June 10, because of falling auto and gasoline sales. This is the Japanese earthquake again, which has crimped supplies of Japanese vehicles and some U.S. models as well. Lack of payroll growth also is constraining sales, economists from IHS Global Insight say.



Producer Price Index for May, due Tuesday, and Consumer Price Index, due Wednesday, both from the Labor Department. Look for little or no change. Reason: Gasoline prices are falling.



Industrial production for May, due Wednesday from the Commerce Department. Look for a small gain. That's because automotive production has been disrupted by parts shortages from Japan.



New York Empire State Manufacturing Index and the Philadelphia Fed Manufacturing Index, due Wednesday and Thursday, respectively. The first comes from the Federal Reserve Bank of New York, the latter from the Philadelphia Federal Reserve Bank. The first is expected to show a decline. The latter may see a gain, according to Nomura Securities. Watch what both reports say about materials costs.



Housing starts and building permits, due Thursday from the Commerce Department. Look for small gains, to an annualized 540,000 units for housing starts and 570,000 units for permits. Both are near record lows and reflect huge inventories of foreclosed homes.



University of Michigan Consumer Sentiment Index. Look for a decline to around 70. The problem is disappointing job growth, falling home prices and volatile stocks. There is some good news that may appear in the index: the positive effect of lower gasoline prices on strained household budgets.

Best 5 stocks to own

Hitting a baseball, they say, is the most difficult feat in sports. No wonder players who hit safely just three times out of 10 at-bats are considered stars. In the corporate world, the elite consists of companies that routinely knock it out of the park during earnings season.




Investing pros refer to these companies as triple plays. They surpass analysts' estimates for profit and sales, and then they raise expectations about future results.



Less than 10% of companies pulled off triple plays in the earnings season that ended this winter, according to Bespoke Investment Group.







The latest on corporate earnings

The least-common component of the triple play is raised guidance, which occurs when a company signals to investors that it will continue to top expectations. Company executives often indicate that they're optimistic by using words like "robust" and "healthy" when talking to Wall Street about demand for their products. This happens less often in uncertain economic climates.



"There are very few companies that are sticking their necks out going forward," says Ron Muhlenkamp, manager of the $635 million Muhlenkamp (MUHLX) fund.



By many measures, however, corporate America has never looked healthier. The country's largest nonfinancial companies hold hundreds of billions of dollars in cash on their balance sheets. When the economy tanked, companies slashed spending to make a profit. Today, more of them are earning profits the old-fashioned way: by increasing sales. And now revenue is rebounding too.



During the slowdown, companies with sales growth tended to be those, like Family Dollar Stores (FDO, news), that catered to budget-conscious consumers. But sales are now closing in on their prerecession peaks, says Aaron Smith, senior economist at Moody's Analytics.



Among triple plays, Apple (AAPL, news) is the paragon, a growth company that continues to confound.



"It's growing at a ridiculous clip," says Michael Sansoterra, manager of the RidgeWorth Large Cap Growth fund (STCAX) and an Apple shareholder.



There are questions about how long Apple can keep creating products that consumers think they can't do without and whether the iPad will start to cannibalize Apple's laptop computer sales. For now, though, many investors think the stock is a bargain, given its growth prospects.



"Can the stock go up another 50%? Sure," says Jerry Jordan, the manager of the Jordan Opportunity Fund (JORDX) fund and an Apple shareholder.



Many investors would contend that Apple is in a category of its own.



For most companies, the ability to beat Wall Street's estimates involves psychology as much as business chops. Investors punish companies that fail to meet estimates. Knowing this, managers often offer conservative guidance (or none at all).



That's why it's noteworthy when executives raise guidance. In effect, they're saying, "Have I got news for you," says Sandeep Dahiya, associate professor of finance at Georgetown University's McDonough School of Business.



Rather than focusing on whether companies beat estimates, investors should use a company's earnings report as a starting point, the pros say.



Many professional investors create their own earnings models for the companies they hold and then compare their own projections with those of analysts and company management. There's often a herd mentality among analysts, some critics say. "By the time everyone upgrades Netflix (NFLX, news) to a "buy," it's too well known" to offer great growth prospects, says Bob Auer, the manager of the Auer Growth (AUERX) fund, whose holdings include the triple play Altera (ALTR, news), a maker of microchips.



A company's earnings can offer a hint about where its share price is headed. Research on so-called "post-earnings-announcement drift" shows that stock prices generally continue to move in the direction of the earnings surprise for up to a year after the announcement.

Here is a closer look at five companies that recently topped sales and profit expectations while raising guidance. The stocks could be good long-term plays.




Apple

The stock trades at 12 times this year's earnings estimates, well below its 10-year average of 47.



What's next? Technology that brings the computer to your TV, analysts say. Apple could use a new hit, since it is facing tough competition from smartphones running the Android operating system from Google (GOOG, news).



Caterpillar

Caterpillar (CAT, news), the world's largest construction-equipment maker, recently agreed to buy mining-equipment manufacturer Bucyrus International (BUCY, news).



"This could be a $150 stock in a couple years," says Craig Hodges, co-manager of the Hodges (HDPMX) fund.



Some critics, however, say it's better to grow profits organically than to pay top dollar to buy a company.



Tempur-Pedic

One might think high-end mattresses would be a tough sell in a shaky economy. Not so for those made by Tempur-Pedic International (TPX, news).



The Lexington, Ky., company recently beat quarterly earnings estimates by an impressive 16%. "They have knocked the cover off the ball," says Hodges, a shareholder.
Boston Beer Company

In September 2008 I predicted that Molson Coors (TAP: 44.19, -0.17, -0.38%) shares would outperform Boston Beer (SAM: 82.00, -1.18, -1.42%), despite the latter making better beer, because the former had lower prices and costs and a more modest stock valuation. I was right for about the first year. Since then I haven't even been close. Consumers didn't trade down to cheaper beer during the recession, and during the current recovery, "better beer," as Boston Beer calls the category that includes its Sam Adams line, has grown much faster than beer in general. Over the past year shares of Boston Beer have gained 69%, versus 15% for shares of Molson Coors. Boston Beer isn't cheap at 25 times forecast earnings, but last year the company increased sales by 12% while larger rivals reported weak or negative growth. Over the past few years the company has shifted from mostly contract brewing to nearly all in-house brewing, reduced delivery times and improved margins. Management is also pushing new "better than better" beers, including its cork-bottle Barrel Room Collection and its $20-a-bottle Infinium Ale.

Southwest Airlines

Sales growth, past four quarters: 18%

Industry sales growth: 15%



Southwest Airlines (LUV: 11.56, -0.01, -0.09%) gained leading market share in dozens of airports by cutting frills (including assigned seating) and offering low fares, and by avoiding crowded hubs. Major carriers have slashed perks of late, too, but Southwest is still growing faster. On Wednesday, the company announced that it received regulatory approval for its proposed merger with discount carrier AirTran. Analysts say the deal offers plenty of opportunity for profitable growth, because Southwest's non-hub model leaves little city overlap. Sales are expected to rise 15% this year, compared with 10% for American Airlines parent AMR (AMR: 5.96, -0.07, -1.16%) and 9% for United Continental (UAL: 22.73, -0.31, -1.35%). Rising oil prices look likely to crimp profits, however. Wall Street expects earnings per share to decline 8% this year. The stock seems reasonably priced, nonetheless. Southwest has no net debt and its shares sell for about 0.7 times yearly sales. That's a 60% discount to the broad stock market.



Whole Foods

Sales growth, past four quarters: 14%

Industry sales growth: 5%



Wondering who sells that aforementioned $20-a-bottle beer? Whole Foods (WFMI: 59.95, 0.00, 0.00%) does. The upscale grocer specializes in markets with higher-income shoppers who are willing to pay up for organic and specialty fare. It, too, got clobbered during the recent recession but has made a remarkable recovery. Read into that what you will about U.S. spending habits or income inequality, but while Kroger (KR: 23.57, -0.19, -0.80%) and Safeway (SWY: 22.28, -0.40, -1.76%) are expected to make do with 6% sales growth in their current fiscal year, Whole Foods is forecast to increase sales twice as fast. Its profit margins are nearly double those of traditional grocers. Shares, alas, are priced like Parmigiano Reggiano. They sell for 36 times earnings, making them slightly more than twice as expensive as the average stock.






Acme Packet

Acme Packet (APKT, news) makes devices that help send data across Internet-protocol networks. The Bedford, Mass., company invented the session border controller, which has become more important as more video and voice data have gone online.



Investors are paying a hefty premium for the stock, however; it trades at 60 times this year's expected earnings.



Altera

This San Jose, Calif., company makes programmable logic devices used in communications network gear, consumer electronics and industrial equipment.



Sales to China contributed one-third of its 2010 revenue of nearly $2 billion.
